How to Get a Cannabis and Hemp License in Thailand:
A Step-by-Step Guide

If you’re thinking about diving into the cannabis or hemp industry in Thailand, you’ve come to the right place. Thailand's laws and regulations are evolving, especially with the new Cannabis-Hemp Act expected to bring more clarity in 2024. Don’t worry—I’ll guide you through each step of the way!

Your Guide to Obtaining a Cannabis and Hemp License in Thailand

If you’re looking to enter the cannabis or hemp industry in Thailand, we’re here to help you navigate the entire process, step-by-step.

From setting up your company to ensuring full compliance with local laws, SiamConsult is by your side to make this journey smooth and straightforward.

Understanding the Legal Framework

To start, it’s important to know that Thailand’s cannabis laws are evolving, especially with the upcoming Cannabis-Hemp Act expected to come into effect in 2024.

While Thailand supports the medicinal, research, and industrial use of cannabis, recreational use remains prohibited. Extracts containing more than 0.2% THC are still considered narcotics, so staying compliant is key to avoiding penalties like fines or imprisonment.

Types of Licenses You May Need

  • Cultivation License:
For growing cannabis plants, whether for commercial, industrial, or medicinal purposes.

  • Production License:
Required if you’re processing cannabis into products like oils, edibles, or pharmaceuticals.

  • Distribution License:
Necessary for selling cannabis products within Thailand.

  • Import/Export License:
For trading cannabis or hemp products internationally.

Eligibility Criteria: What You Need to Know

  • Thai Ownership:
At least 51% of your company’s shares must be owned by Thai nationals.
Additionally, two-thirds of the management team and the capital must also be Thai-owned.
As a foreign investor, you can still participate by forming a joint venture with a local partner.

  • Business Registration:
Your company must be set up as a Thai Limited Company.
This involves a few steps, including registering your business, obtaining a work permit, and securing a business visa if you’re a foreigner.
Don’t worry—we can handle these details for you.

  • Compliance with Standards:
Strict regulations govern THC content, security measures, and record-keeping.
For example, cannabis extracts should not exceed 0.2% THC, and smoking cannabis in shops is not allowed.

  • Legal Requirements:
The applicant must be at least 20 years old, have a residence or office in Thailand, be financially solvent, and free from criminal records related to narcotics.
